By accessing or using UBTApp, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

2. Description of Service

UBTApp is a multi-tenant Korean language examination platform that provides:

  • Online exam creation and management tools for institutes
  • Practice exams for students (UBT, TOPIK, CBT, and other exam types)
  • AI-powered question generation
  • Performance analytics and reporting
  • Payment processing for exam purchases and subscriptions

3. User Accounts

3.1 Account Registration

To use certain features, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 13 years of age
  • Accept responsibility for all activities under your account

3.2 Account Types

  • Institute Accounts: For training centers and educational organizations
  • Student Accounts: For individual learners and exam takers
  • Admin Accounts: For institute administrators

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or misuse the platform.

4. Subscriptions and Payments

4.1 Institute Subscriptions

  • Annual subscriptions are billed yearly in advance
  • A 7-day free trial is available for new institute accounts
  • Subscriptions automatically renew unless cancelled
  • You can cancel your subscription at any time through your account settings

4.2 Student Payments

  • Exam purchases are one-time payments
  • Package purchases provide access to multiple exams
  • Free exams are available without payment or registration

4.3 Payment Methods

We accept:

  • eSewa (online payment)
  • Bank transfers
  • Cash payments (contact sales team)

4.4 Refund Policy

We do not offer refunds once payment has been processed. We provide a 7-day free trial for institutes to fully test our platform before committing to a paid plan. If you encounter any issues after purchase, our support team is available to help resolve them.

5. Acceptable Use Policy

You agree NOT to:

  • Use the platform for any unlawful purpose
  • Share account credentials with unauthorized users
  • Attempt to access other users' accounts or data
  • Reverse engineer or copy any part of the platform
  • Distribute copyrighted exam content without permission
  • Use bots, scripts, or automated tools to manipulate exams
  • Engage in cheating, plagiarism, or academic dishonesty
  • Upload malicious code, viruses, or harmful content
  • Interfere with the platform's operation or security

6. Intellectual Property Rights

6.1 Platform Ownership

UBTApp and all its features, design, code, and branding are owned by us and protected by copyright, trademark, and other intellectual property laws.

6.2 User Content

Institutes retain ownership of exam content they create. By uploading content, you grant us a license to store, display, and process that content to provide our services. Students retain ownership of their answers and submissions.

6.3 AI-Generated Content

Questions generated using our AI tools are owned by the institute that generated them. We may use anonymized data from AI-generated content to improve our AI models.

7. Exam Integrity and Academic Honesty

Students and exam takers must:

  • Complete exams independently without unauthorized assistance
  • Not share exam questions or answers with others
  • Not use external resources during proctored exams
  • Follow all exam instructions and time limits

Violation of academic integrity may result in exam invalidation, account suspension, and notification to your institute.

8. Data and Privacy

Your use of UBTApp is also governed by our Privacy Policy. We collect and process personal data as described in that policy. By using our platform, you consent to such processing.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted or error-free service. The platform is provided "as is" without warranties of any kind.

9.2 Exam Results

While we use accurate grading algorithms, we are not responsible for any consequences resulting from exam scores or performance analytics. Exam results are for practice and educational purposes.

9.3 Limitation of Liability

To the maximum extent permitted by law, UBTApp shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid us in the past 12 months.

10. Indemnification

You agree to indemnify and hold UBTApp harmless from any claims, damages, losses, or expenses arising from your violation of these terms, misuse of the platform, or infringement of any rights of third parties.

11. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the modified terms.

12. Governing Law and Dispute Resolution

These terms are governed by the laws of Nepal. Any disputes shall be resolved through:

  • First, good faith negotiation between the parties
  • If unresolved, mediation in Kathmandu, Nepal
  • If mediation fails, arbitration under Nepali law

13. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
